SocialSure Pvt. Ltd. (“we,” “us”) values your trust. This Privacy Policy outlines how we collect, use, and protect your data in compliance with the Digital Personal Data Protection Act, 2013 (DPDP Act) and the Information Technology Act, 2000.

2. DATA WE COLLECT

We collect the following categories of Data Principals' (User) information:

  • Identity Data: Name, Email, Phone Number, Digital Signature details.
  • Professional Data: PAN Card, GST Number, Bank Account details (for Payment Protection Forms).
  • Platform Data: OAuth tokens from social media platforms (Instagram, YouTube, etc.) to analyze follower count, engagement rates, and niche.
  • Interaction Data: Chat logs with the AI Legal Bot.

3. HOW WE USE YOUR DATA

We process your data for the following specific purposes:

  • Service Delivery: To generate legally binding contracts and Payment Protection forms.
  • AI Matching: To train our proprietary matching engine to connect Creators with Brands based on performance metrics.
  • Risk Assessment: To audit accounts for the "Quarterly Digital Risk Audit" (Elite Plan).
  • Legal Compliance: To verify identity (KYC) and prevent fraud.

4. AI AND AUTOMATED PROCESSING

  • Disclosure: We use Artificial Intelligence (AI) and Machine Learning (ML) technologies to process your data.
  • Chatbot: Your queries are processed by LLMs (e.g., Gemini) to generate responses. Do not share sensitive personal confessions or trade secrets with the bot.
  • Matching: Our algorithms automatically profile your social media performance to suggest brand deals.

5. DATA SHARING AND DISCLOSURE

We do not sell your data. We share data only in the following ways:

  • With Counterparties: Your KYC and contact details are shared with the specific Brand or Creator you enter into an agreement with.
  • With Legal Partners: If you request a human consultation or escalation, your case details are shared with our empanelled lawyers.
  • Legal Requirements: We may disclose data if required by Indian law enforcement or court order.

6. DATA SECURITY

We use industry-standard encryption (SSL/TLS) to protect your data during transmission. Digital signatures and timestamps on contracts are stored using secure hashing protocols to ensure evidentiary value under the Bharatiya Sakshya Adhiniyam, 2023.

7. YOUR RIGHTS

Under the DPDP Act, you have the right to:

  • Access: Request a summary of your personal data processed by us.
  • Correction: Update or correct your personal data.
  • Withdraw Consent: You may withdraw consent for AI processing, but this may limit your access to the Marketplace and Chatbot.
  • Grievance Redressal: Contact our Grievance Officer for any privacy concerns.
